Please read these Terms and Conditions ("Terms") carefully before using Safely Gathered ("the Service"). The Service is operated by Max Caps LLC, a Colorado limited liability company doing business as Safely Gathered ("Safely Gathered," "we," "us," or "our"). By creating an account, accessing, or using the Service in any way, you agree to be legally bound by these Terms in their entirety. If you do not agree, do not use the Service.
Safely Gathered, operated by Max Caps LLC (d/b/a Safely Gathered), sends SMS notifications to approved volunteer security team members. By providing your mobile phone number and accepting these Terms, you agree to receive SMS messages from Safely Gathered. Message types include emergency safety alerts, event reminders, and new event notifications. Message frequency varies based on your event schedule and site activity. Message and data rates may apply. Reply STOP at any time to unsubscribe from non-emergency messages, or HELP for assistance. By accessing or using Safely Gathered, you represent and warrant that you: (a) are at least 18 years of age; (b) have the full legal authority to agree to these Terms; (c) are not barred from receiving the Service under any applicable law; and (d) agree to be bound by these Terms and all policies incorporated herein, including the Privacy Policy. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization.
Safely Gathered is a volunteer security team coordination platform designed for churches and faith-based organizations. It provides tools for volunteer scheduling and assignments, team and event chat (including image attachments), incident and emergency reporting, SMS and email notifications, volunteer applications and approvals, and site and policy management.
IMPORTANT: Safely Gathered is a coordination and communication tool ONLY. It is NOT a professional security service, law enforcement agency, emergency response provider, monitoring service, or a substitute for any of the foregoing.
Safely Gathered does not guarantee the prevention of harm, injury, theft, or any other incident. In any emergency, users must contact law enforcement by calling 911 immediately. The Service must never be used as a substitute for professional emergency services.
To the fullest extent permitted by law, Safely Gathered and its owners, officers, employees, contractors, and affiliates shall not be liable for: any failure to deliver alerts, notifications, or messages; any harm, injury, death, or damage arising from any emergency or security incident; any failure of volunteers to respond or to respond adequately; any technical failures, delays, or outages; any user actions or omissions; or any third-party service failures, including SMS, email, hosting, database, or payment-processor failures. Your organization is solely responsible for its own security protocols, staffing, and emergency procedures.
You are responsible for providing accurate information and for maintaining the confidentiality of your account credentials. Authentication is provided through our hosting provider, Base44, using an email address and password.
The Service includes the following account and role types:
All users must be at least 18 years of age. Safely Gathered may suspend or terminate any account that violates these Terms.
Prospective volunteers may apply to join a site using a site access code, submitting their name, email address, phone number, and requested role. Administrators and authorized site roles review, approve, or reject applications and may record internal notes. Approval and vetting of volunteers is performed by your organization; Safely Gathered does not conduct background checks, identity verification, or any independent screening of applicants, and makes no representation regarding the suitability, trustworthiness, or qualifications of any volunteer.
New administrator accounts receive a 30-day free trial with no charge. After the trial, the Service is billed at $99.99 USD per month per site. You authorize recurring monthly charges to your payment method. Cancellation before the end of the trial incurs no charge. When you add sites or change your subscription mid-cycle, charges may be prorated. No refunds are issued for partial billing periods. Accounts with failed payments may be locked or suspended, and affected sites may be scheduled for deactivation and removal. Payment processing is handled by Stripe; Safely Gathered does not store your full card number or CVV.
You agree not to use Safely Gathered to: harass, threaten, or harm individuals; send false emergency alerts or false incident reports; impersonate any person or agency; violate any applicable law; interfere with or disrupt the Service; gain unauthorized access to any account, site, or data; use the Service for commercial purposes unrelated to volunteer security coordination; collect other users' data without consent; upload malicious code; or upload images or content that are unlawful, harassing, or that you do not have the right to share. Misuse of the emergency alert system may result in immediate account termination and referral to law enforcement.
By providing a phone number and accepting these Terms, you consent to receive SMS notifications from Safely Gathered, including:
Message and data rates may apply. Event reminders and new event notifications can be disabled individually in your account Settings at any time. You may also opt out of all non-emergency SMS at any time by replying STOP to any message; reply START to re-enable, or HELP for assistance, or contact support@safelygathered.com. Message frequency varies based on your event schedule and site activity. SMS delivery is facilitated by Twilio and cannot be guaranteed; Safely Gathered is not liable for carrier delays or failures.
Safely Gathered relies on the following third-party service providers to operate the Service:
By using the Service, you acknowledge that your data may be processed by these providers as necessary to deliver the Service. Safely Gathered is not responsible for any third-party service failures. Additional detail is provided in our Privacy Policy.
Your use of Safely Gathered is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described therein.
Incident reports, chat messages, uploaded images, policies, site instructions, and related records are associated with the administrator organization's site. When a site is deactivated (including following account cancellation or unresolved billing), these records are scheduled for permanent deletion after a 90-day retention window. Incident and other data may be subject to subpoena or other legal process. Your organization is responsible for maintaining its own independent records as needed.
The Service is provided on an "as available" basis with no guarantee of uptime, availability, or alert or message delivery times.
Safely Gathered is not liable for delays or failures caused by events beyond its reasonable control, including acts of God, natural disasters, war, government action, power failures, internet or network outages, cyberattacks, or third-party service failures.
The Service and all associated content, features, trademarks, and software are owned by Max Caps LLC (d/b/a Safely Gathered). You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for volunteer security team coordination. You retain ownership of the content your organization submits (such as incident reports, messages, and images), and grant Safely Gathered a license to host, process, and display that content as necessary to provide the Service. Unauthorized use of the Service is a material breach of these Terms.
The Service is provided "as is" and "as available" without warranty of any kind, express or implied. Safely Gathered does not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is entirely at your own risk.
To the fullest extent permitted by law, Safely Gathered shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Safely Gathered's total cumulative liability shall not exceed the amount you paid for the Service in the three calendar months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Safely Gathered and Max Caps LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, your violation of any law, or any security incident at your site.
Before initiating a formal dispute, you agree to contact support@safelygathered.com and attempt informal resolution for 30 days. Any dispute not resolved informally shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in Colorado Springs, Colorado. Each party may bring claims only in its individual capacity, and not as a plaintiff or class member in any class or representative proceeding.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Any claim not subject to arbitration shall be brought exclusively in the state or federal courts located in El Paso County, Colorado.
If any provision of these Terms is found invalid or unenforceable, it shall be modified or severed, and the remaining provisions shall continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Safely Gathered. Our failure to enforce any right or provision is not a waiver of that right or provision.
Safely Gathered may modify these Terms at any time. We will provide at least 14 days' email notice to administrators before material changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
